These Terms of Use  (“Agreement”) govern your access and use of the RoleScale.com platform and related services (“Services”). By creating an account, uploading your resume, or taking an interview on RoleScale.com, you agree to be bound by this Agreement. These Terms of Use outline the rules and responsibilities for using our services. By accessing and using RoleScale Inc.’s platform, you acknowledge that you have read, understood, and agreed to abide by these terms

1.  Eligibility and Account Registration: You must be at least 18 years old and have the legal capacity to enter into this Agreement to use the Services. You must also provide accurate and complete information when creating an account on RoleScale.com. You are responsible for maintaining the security and confidentiality of your account credentials and any activities that occur under your account. 2.  Services and Content RoleScale.com allows you to take a one-way AI screening interview for various job positions offered by employers who use our Services. The interview consists of questions created by the recruiter or generated by our AI algorithm based on the job description and your resume. You will be asked to record your answers using your webcam and microphone. Our AI algorithm will analyze your answers and score based on various criteria, such as relevance, clarity, confidence, personality traits (OCEAN), etc. Your score resume and profile information will be shared with the employer who posted the job position. The employer may then contact you for further steps in the hiring process.

You acknowledge and agree that:

1. 1. The questions and scores generated by our AI algorithm are not intended to be definitive or conclusive assessments of your suitability for any job position. They are only meant to provide an initial screening and feedback for the employer or the recruiter.
   2. The employer is solely responsible for making any hiring decisions based on your interview results and other information. RoleScale.com does not guarantee that you will receive any job offers or interviews from any employer.
   3. You are solely responsible for the content and quality of your answers and resume. You must ensure that they are truthful, accurate, relevant, and do not violate any laws or rights of others.
   4. You grant us a non-exclusive, royalty-free, worldwide license to use, reproduce, modify, distribute, display, and perform your answers and resume for the purpose of providing the Services to you and the employer.
   5. We may use aggregated and anonymized data from your answers and resume to improve our Services, conduct research, or provide insights to other users or employers.
   6. We will save your video answers for a short period of time (no longer than 30 days) and will only share them with the employer or any third party with your consent.

3.  Rules of Conduct: You agree to use the Services in a lawful, respectful, and professional manner. You agree not to:

1. 1. Cheat, manipulate, or interfere with the interview process or the AI algorithm in any way.
   2. Impersonate someone else or provide false or misleading information about yourself or your qualifications.
   3. Harass, abuse, threaten, defame, or discriminate against anyone on the basis of race, color, religion, sex, national origin, age, disability, or any other protected status.
   4. Violate any intellectual property rights or privacy rights of others.
   5. Transmit any viruses, malware, or other harmful code or content through the Services.
   6. Attempt to access or use the Services in an unauthorized manner, such as hacking, scraping, crawling, etc.

We reserve the right to monitor, review, remove, or modify any content or activity on the Services that we deem inappropriate or unlawful. We also reserve the right to suspend or terminate your account or access to the Services at any time and for any reason.

4.  Accessibility and Accommodation: We are committed to providing equal access and opportunity to all users of our Services. If you have a disability that may affect your ability to take the automated interview or may impact your scoring on RoleScale.com, you may request an accommodation by contacting us at info@rolescale.com before taking the interview. We will try our best to accommodate your needs and adjust our AI algorithm accordingly. However, we cannot guarantee that we will be able to provide accommodation for every request or situation.

5.  Data Usage:

1. 1. Machine Learning Algorithm: You acknowledge and agree that your information and interactions on the Platform may be used to enhance the machine learning algorithm, improving the accuracy and effectiveness of the assessment process.
   2. Video Content and Services: RoleScale provides its Customers the ability to take video interviews and tools to use in association with the RoleScale Services. If you choose to use your webcam and microphone through RoleScale Services for audio and video communications, you authorize RoleScale to allow others to see and hear you through the audio and video obtained through these devices. You also authorize RoleScale to record and store such information on its servers in your Account. Please note that RoleScale will not use your recorded content for any purpose unrelated to your Account.

6.  Disclaimer of Warranties and Limitation of Liability: The Services are provided “as is” and “as available” without any warranties of any kind, either express or implied. We do not warrant that:

1. 1. The Services will meet your expectations or requirements.
   2. The Services will be uninterrupted, timely, secure, error-free, or accurate.
   3. The results obtained from the use of the Services will be reliable or effective.
   4. Any errors or defects in the Services will be corrected.

You agree that your use of the Services is at your sole risk and discretion. You assume full responsibility and liability for any loss or damage arising from your use of the Services or any content or information obtained through the Services. To the fullest extent permitted by law, we and our affiliates, partners, licensors, and agents disclaim any and all liability for any direct, indirect, incidental, consequential, special, or exemplary damages, including but not limited to loss of profits, revenue, data, goodwill, or other intangible losses, resulting from or relating to your use of or inability to use the Services, even if we have been advised of the possibility of such damages.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities, so some of the above exclusions or limitations may not apply to you. In such cases, our liability will be limited to the maximum extent permitted by law.

7.  Indemnification: You agree to indemnify, defend, and hold harmless us and our affiliates, partners, licensors, and agents from and against any and all claims, demands, actions, liabilities, damages, costs, and expenses, including reasonable attorney’s fees, arising from or relating to:

8.  Governing Law and Dispute Resolution This Agreement shall be governed by and construed in accordance with the laws of the State of Florida, USA, without regard to its conflict of laws principles. Any dispute arising from or relating to this Agreement or the Services shall be submitted to the exclusive jurisdiction of the state and federal courts located in the state of Florida, USA. You agree to waive any objection to such jurisdiction and venue.

9.  Changes to this Agreement: We may revise and update this Agreement from time to time at our sole discretion. We will notify you of any changes by posting the new version on our website or emailing you. Your continued use of the Services after the effective date of the changes will constitute your acceptance of the new Agreement. If you disagree with the new Agreement, you must stop using the Services.
